{"id":4780,"date":"2025-04-30T10:27:01","date_gmt":"2025-04-30T00:27:01","guid":{"rendered":"https:\/\/theonsitemanager.com.au\/news\/?p=4780"},"modified":"2025-04-30T10:27:03","modified_gmt":"2025-04-30T00:27:03","slug":"selling-your-property-this-year","status":"publish","type":"post","link":"https:\/\/www.theonsitemanager.com.au\/news\/selling-your-property-this-year\/","title":{"rendered":"SELLING YOUR PROPERTY THIS YEAR?"},"content":{"rendered":"\n<p>NEW DISCLOSURE REQUIREMENTS COMMENCE 1 AUGUST 2025<\/p>\n\n\n\n<p>In 2023, the Queensland Government introduced significant changes to property law with the passing of the <em>Property Law Act 2023<\/em> and <em>Property Law Regulation 2023<\/em>. One of the most important reforms is the new statutory<strong> <\/strong>seller disclosure scheme, which applies to the sale of all freehold land in Queensland from <strong>1 August 2025<\/strong>.<\/p>\n\n\n\n<p><strong>What does this mean?<\/strong><\/p>\n\n\n\n<p>Before a buyer signs a contract to purchase a lot, the <strong>seller must provide<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A Seller Disclosure Statement for the property; and&nbsp;<\/li>\n\n\n\n<li>All documents or certificates <strong>prescribed by regulation.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>The form of the Seller Disclosure Statement has been through various iterations. The most current version available here <a href=\"https:\/\/www.publications.qld.gov.au\/ckan-publications-attachments-prod\/resources\/7a1be178-d2d5-4744-9147-9699c04ee8d8\/seller-disclosure-statement-form-2.pdf?ETag=aca5f8db01e9c5369d0777a1e077a722\">seller-disclosure-statement-form-2.pdf<\/a><\/p>\n\n\n\n<p><strong>What Must Be Disclosed?<\/strong><\/p>\n\n\n\n<p>The Seller Disclosure Statement outlines key legal and practical details about the property. This includes (amongst other things):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Title search and plan image;<\/li>\n\n\n\n<li>If the property is part of a community titles scheme:\n<ul class=\"wp-block-list\">\n<li>The Community Management Statement; and&nbsp;<\/li>\n\n\n\n<li>A Form 33 Body Corporate Certificate (replacing the old BCCM s206 disclosure statement);<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Any current residential tenancy or rooming accommodation agreements;<\/li>\n\n\n\n<li>Land use, zoning, and transport proposals, infrastructure or resumption notices;<\/li>\n\n\n\n<li>Whether the property is listed on the Contaminated Land Register or Environmental Management Register;<\/li>\n\n\n\n<li>Any applications or orders under the <em>Neighbourhood Disputes (Dividing Fences and Trees) Act 2011 (Qld);<\/em><\/li>\n\n\n\n<li>Local government zoning and heritage listings (both Qld and Commonwealth registers);<\/li>\n\n\n\n<li>Notices related to buildings and structures (e.g. show cause or enforcement notices);<\/li>\n\n\n\n<li>Pool compliance certificates; and<\/li>\n\n\n\n<li>Current rates and water information.<\/li>\n<\/ul>\n\n\n\n<p>You can access a copy of the most up-to-date version of the Form 33 here <a href=\"https:\/\/www.publications.qld.gov.au\/ckan-publications-attachments-prod\/resources\/1396e9b2-ce27-4557-8066-428b193f5511\/bccma-form-33-body-corporate-certificate-watermarked.pdf?ETag=c46fd5193af8111632cb33dfd3e6f35c\">bccma-form-33-body-corporate-certificate-watermarked.pdf<\/a>.<br><\/p>\n\n\n\n<p><strong>Additional Disclosure Required in Form 33 (if the property is in a Community Titles Scheme)<\/strong><\/p>\n\n\n\n<p>The Form 33 is more comprehensive than its predecessor and includes details that a buyer should be aware of, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Amounts payable or owed to the body corporate by the seller;<\/li>\n\n\n\n<li>The body corporate\u2019s sinking fund balance;<\/li>\n\n\n\n<li>Details of any caretaking or letting agreements;<\/li>\n\n\n\n<li>A copy of the current Building Management Statement;<\/li>\n\n\n\n<li>Any embedded electricity network arrangements;<\/li>\n\n\n\n<li>The most recent statement of accounts for the lot being purchased;<\/li>\n\n\n\n<li>Any other amounts payable by the buyer;<\/li>\n\n\n\n<li>Details of seller-responsible improvements to common property;
